I am doing a mortgage Mod in New York State. My lender see that my old privet lender did not get there name off my title and will not complete the Mod unless this is done. I can get the old lender to sign any papers needed However do I need a lawyer to file this in New York or can I do the leg work myself. I call a few local lawyers but none seem to want to do this.
Under New York law, requires :
The mortgage holder to provide you with a satisfaction of the mortgage within 90 days of the date it is paid off and to record the satisfaction as well if the property is a one to six family owner occupied, residential structure or residential condominium unit.
If the mortgage company fails to comply with the statute, you are entitled to actual damages and statutory damages of $500.00.
