Husband got DUI ticket…CDL question & more…?
My husband received DUI ticket last week. Cops took him in, he blew low level, they took his blood and drove him home letting him keep his driver’s license. He goes to court Tuesday, will have to use Public Defender. He has a CDL (drives locally in Az only). Free consultation lawyer told him would take 4-6 weeks for bloodwork results to come back. But he did not ask the important questions while there…
1) Will he meet w/Pub Defender on Tuesday and have to enter plea then or will he receive a new date to meet with him?
2) When/if he is found guilty, will that not be 4-6weeks from now after bloodwork is returned, and how long after that will CDL Board be alerted which will make him loose his job?
3) 20 years ago(1989) he got low level DUI in Texas, received community service time & suspended license 30days… will that become known and make this a 2nd offense even tho so long ago?
He must notify his employer by law ( US D.O.T )
The employer notifies the licensing agency.
Public Defenders tend to plea people too quickly. Be careful- their hearts are really in it. He probably will lose his CDL -sorry bad time to do so.
The court date has to be after the results are returned.
Don’t mention the DUI from 20 years ago- the burden is on the police to discover. Do not ever – ever volunteer information.
