Who is responsible for my slip and fall accident on wet floor of Supermarket?
Last year I suffered injury when I had a slip and fall accident on a wet floor in a well known Supermarket and they tell my solicitor that they are not responsible but that the accident is due to the negligence of the contract cleaner employed by them. As the accident was a few minutes past opening time then this may well be the case but surely the supermarket is directly responsible towards me and it should be the supermarket to compensate me and then they should sue the contract cleaner. Can anybody enlighten me. Thank you.
primarily, the supermarket should be responsible for it. the negligence of the contract cleaner is their responsibility. even if there is warning sign, they had admitted that the contract cleaner is at fault. u have a strong case to claim against them which they will usually pay through the public liability insurance that they had and then it is up to them to claim back from the contract cleaner which is none of ur business.
in future, get urself covered with accident insurance plans which should be quite cheap as this process of claiming from them can be quite long. it is cheap in my country but i am not sure how is it like in urs? u claim from ur insurance co and let the ins co claim from them. save ur trouble.
