Please help. My friend purchased in Md a truck for her son and a SUV for herself.?

She was told by MVA that she had a fine to pay of over 3K. She inturn put her son’s name on the title.
Her son had the SUV towed he is 19 yrs old and moved out. He now has her SUV and his truck she
bought him. She never thought her son would or could do this to her. She received large settlement.
Has paid his insurance for 6 months. She has copies of everything. The son is screwing her over, what can she do? She just found out that she owed 207.00 to the MVA. How can she get her Suv Back? His name is on the title. She did meet with a attorney but he did not refer her to a auto attorney. Now she has no vehicle. What can she do? Can a judge grant her the Suv back? She has no money because she purchased her Suv and her son a truck. Of course she had no idea he would do this ?? Who would? I feel awful for her. Please help?

Let’s start with the basics. Your friend had an insurance lapse, and owes a fine to the state for the lapsed coverage. With her Soundex (driver’s license number) flagged, she could not register a vehicle, nor could she renew any registration on any currently owned vehicle.

Rather than paying the fine that she owed, she put two vehicles into her son’s name. The son became the legal owner of both vehicles, and she had no legal ownership interest in them. As such, he had the legal right to take them. If she had paid her fine, and put the vehicle in her name, she would not have this problem.

Unless there is a written agreement, the mother has no legal claim on the vehicles. They would be considered to be gifts. A judge would look at the case as an attempt to a avoid a fine, and would not be likely to enforce a verbal agreement.

Sorry, but when you try to avoid the consequences of your actions, you sometimes end up in a much worse position. She now has no vehicle, and still owes the state. They will seize tax returns and add interest and penalties to the balance, until it is paid.
